In a follow-up to our investigation into the tragic murder of 8-year-old JaeLuv Smith, his birth mother has filed a wrongful death lawsuit against Fresno County.
The county of Fresno, as well as two social workers, are now being sued.
JaeLuv Smith was discovered with marks around his wrists, ankles, and neck, according to Child Protective Services paperwork.
Several fractures were visible, and a BB was discovered stuck in his thigh.
The report contained contradictions, according to the director of the Fresno County Department of Social Services.
The law company handling the matter now wants someone to be held responsible.
“We filed a claim on behalf of JaeLuv’s estate for the pain and suffering he went through before his death,” Roger Booth, Booth Law Firm, said.
The County of Fresno is being sued for wrongful death over JaeLuv Smith’s previous CPS investigations.
The county had looked into two previous referrals.
The complaint claims that these investigations could have saved JaeLuv.
“If something would have been done at that point there’s a good chance JaeLuv could have been saved,” Booth said.
The lawsuit states “The County of Fresno violated various mandatory duties and is therefore liable.”
JaeLuv was four years old at the time of the first CPS inquiry in 2016.
The lawsuit alleges that social services are being misused. “Failed to interrogate the victim of the abuse, as well as JaeLuv’s biological mother and grandmother, who were both mentioned as knowing about the abuse.”

The guardians who were the accused abusers were present when the social workers interviewed JaeLuv in both cases.
A required reporter revealed in the 2020 CPS investigation that JaeLuv was at school with a sore hand.
JaeLuv informed the principal that he had been hit by a hanger. He was also limping, according to the records.
His left foot’s top was black and blue. This investigation took less than a week to open and close.
